Slovin & Council, Co., LPA ("we," "us," or "the Firm") is a debt collector, as defined by 15 U.S.C. § 1692a(6), and this is an attempt to collect a debt. Any information obtained by us will be used for that purpose.

These Terms of Service ("Terms") govern your access to and use of the online payment portal (the "Portal") operated by Slovin & Council, Co., LPA. By accessing the Portal, creating an account, or making or scheduling a payment, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Portal.

Acceptance of Terms

By using the Portal, you acknowledge and agree to each of the following:

     You accept these Terms and Conditions and wish to proceed with making a payment or managing your account(s).

     You have read and understood the Slovin & Council, Co., LPA Privacy Policy.

     You acknowledge that Slovin & Council, Co., LPA is a debt collector.

Online Payments

By making an online payment or scheduling a payment plan through the Portal, you agree to the following terms:

     You understand that despite making a payment or scheduling a payment plan, you may still have legal obligations related to the account(s). You further acknowledge that despite your payment(s), the creditor and/or the Firm may pursue certain legal actions.

     You understand that the balance on your account may not accurately reflect recent payments sent to the offices of the Firm due to delays in the receipt and application of payments, particularly those payments sent by courts and third parties.

     You authorize the Firm to process the payment(s) you initiate or schedule using the payment method you provide, in the amounts and on the dates you specify.

     You represent that you are the authorized holder of the payment method used and that you have sufficient funds or credit available to complete the transaction.

Portal Account Creation

You acknowledge that you are a party to any file(s) for which you create an account. You also agree that if you are accessing any information on the Portal, you are the consumer on the accounts serviced by the Firm, or you are authorized by the consumer to access any and all accounts related to the consumer which are serviced by the Firm.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Electronic Communications and Consent

By using the Portal, you may elect to receive communications from the Firm electronically, including by email and SMS (text message). Your consent to electronic communications is governed by our E-Sign Consent & Disclosure, Email Communication Consent, and SMS Communication Consent, each of which is available on the Portal. You may withdraw consent or opt out of electronic communications as described in those documents.

Acceptable Use

You agree to use the Portal only for lawful purposes and in accordance with these Terms. You agree not to:

     Use the Portal for any fraudulent or unlawful purpose.

     Impersonate any person or entity or misrepresent your identity or authorization to access an account.

     Interfere with or disrupt the operation of the Portal or attempt to gain unauthorized access to any portion of it.

     Transmit any virus, malware, or other harmful code, or otherwise compromise the security of the Portal.

The information you obtain on the Portal is not, nor is it intended to be, legal advice. You should consult an attorney for advice regarding your individual situation. We invite you to contact us and welcome your calls, letters, and electronic mail. Contacting us does not create an attorney-client relationship. Please do not send any confidential information to us until such time as an attorney-client relationship has been established.

Disclaimer of Warranties

THE PORTAL AND ALL CONTENT AND FUNCTIONALITY ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THIS DISCLAIMER APPLIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE FIRM BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF, OR INABILITY TO USE, THE PORTAL, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF THE FIRM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Changes to These Terms

We may revise or update these Terms at any time at our sole discretion by posting an amended version on the Portal. Any changes will be effective upon posting, and the “Last updated” date will reflect the most recent revision. Your continued use of the Portal following the posting of an updated version constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

Governing Law

Slovin & Council, Co., LPA maintains its office in Cincinnati, Ohio, and conducts collection litigation in Ohio, Kentucky, and Indiana. These Terms and your use of the Portal are governed by the laws of the State of Ohio, without regard to its conflict-of-law provisions, except where the law of the state in which you reside applies and cannot be waived. Nothing in these Terms limits any rights afforded to you under applicable federal or state consumer-protection law, including the Fair Debt Collection Practices Act.
